August 2026<\/strong>.<\/p>\n<p>The EU PPWR applies from 12 August 2026, but many operational requirements have separate later or conditional application dates.<\/p>\n<p>Importers, manufacturers, own-brand operators, distributors, and packaging suppliers should prepare product-level technical files, conformity documentation, traceability data, PFAS evidence for food-contact packaging, and implementation plans for recyclability, recycled content, labelling, compostability, packaging minimisation, EPR, and deposit-return requirements.<\/p>\n<p>Several major deadlines are conditional. Recyclability grades A, B, or C generally become mandatory from <strong>1 January 2030 or 24 months after the relevant delegated acts enter into force, whichever is later<\/strong>. Plastic recycled-content requirements apply from <strong>1 January 2030 or three years after the relevant implementing act enters into force, whichever is later<\/strong>.<\/p>\n<p>The Commission\u2019s deadline for adopting harmonised-labelling rules is not the same as the date when every package must carry the final label. Importers must verify that the required steps have been completed before placing packaging on the EU market.<\/li>\n<li><strong>Design f\u00fcr Recycling:<\/strong> Packaging must achieve recyclability grades <strong>A, B, or C<\/strong> von <strong>1 January 2030 or 24 months after the relevant delegated acts enter into force, whichever is later<\/strong>. From <strong>1 January 2038<\/strong>, packaging generally must achieve grade A or B.<\/li>\n<li><strong>Plan for recycling at scale:<\/strong> In addition to design-for-recycling requirements, the recycled-at-scale requirement is scheduled from <strong>1 January 2035 or five years after the relevant implementing acts enter into force, whichever is later<\/strong>.<\/li>\n<li><strong>Prepare for mandatory recycled content:<\/strong> The 2030 minimums are <strong>30% for PET contact-sensitive packaging<\/strong>, <strong>10% for other contact-sensitive plastic packaging<\/strong>, <strong>30% for single-use plastic beverage bottles<\/strong>und <strong>35% for other plastic packaging<\/strong>, subject to applicable exemptions and the conditional date in Article 7.<\/li>\n<li><strong>Check compostable formats:<\/strong> Unter <strong>12 February 2028<\/strong>, permeable tea, coffee, or other beverage bags, soft after-use single-serve units, and sticky labels attached to fruit and vegetables must comply with the applicable industrial-composting standard. Home-composting compatibility is also required where a Member State requires it.<\/li>\n<li><strong>Separate rulemaking dates from business deadlines:<\/strong> The Commission must adopt implementing acts for harmonised packaging and waste-receptacle labels by <strong>12. August 2026<\/strong>. Most packaging material labels apply from <strong>12 August 2028 or 24 months after the relevant acts enter into force, whichever is later<\/strong>.<\/li>\n<li><strong>Review DRS exposure:<\/strong> Unter <strong>1 January 2029<\/strong>, Member States must ensure at least 90% separate collection by weight for specified single-use plastic beverage bottles and single-use metal beverage containers with capacities of up to three litres, subject to PPWR exemptions.<\/li>\n<li><strong>Control PFAS in food-contact packaging:<\/strong> Von <strong>12. August 2026<\/strong>, Article 5(5) establishes three PFAS limit values: <strong>25 ppb for an individual targeted PFAS<\/strong>, <strong>250 ppb for the sum of targeted PFAS<\/strong>und <strong>50 ppm for total PFAS, including polymeric PFAS<\/strong>.<\/li>\n<li><strong>Use current market data:<\/strong> Eurostat reported that the EU generated <strong>79.7 million tonnes<\/strong> of packaging waste in 2023, equal to <strong>177.8 kg per person<\/strong>. The EU recycled <strong>42.1%<\/strong> of generated plastic packaging waste that year.<\/li>\n<\/ul>\n<div class=\"bioleader-note-box\">\n<p><strong>2026 implementation update:<\/strong> On 10 June 2026, the European Commission published official guidance for Regulation (EU) 2025\/40. The guidance responds to interpretation questions raised by businesses and Member State authorities. This online article contains the latest August 2026 corrections and should be used together with the original PDF.<\/p>\n<p><a href=\"https:\/\/www.bioleaderpack.com\/wp-content\/uploads\/2025\/09\/PPWR_Compliance_WhitePaper_FullReport.pdf\" target=\"_blank\" rel=\"noopener\"><strong>Download the EU PPWR Compliance White Paper PDF<\/strong><\/a><\/p>\n<\/section>\n<hr \/>\n<section>\n<h2>1) Scope and Roles: Why Importers and Brands Carry First-Line Duties<\/h2>\n<p><strong>An EU importer may place packaging on the market only after verifying the manufacturer\u2019s conformity assessment, technical documentation, labelling, and traceability requirements.<\/strong><\/p>\n<ul>\n<li><strong>Broad applicability:<\/strong> PPWR applies to all packaging, regardless of the material used, and to packaging waste generated across industrial, commercial, retail, distribution, service, office, and household activities.<\/li>\n<li><strong>Manufacturer responsibility:<\/strong> Manufacturers may place only compliant packaging on the market. They must complete the applicable conformity assessment procedure, prepare Annex VII technical documentation, and draw up the EU declaration of conformity.<\/li>\n<li><strong>Importer responsibility:<\/strong> Before placing packaging on the market, importers must verify that the manufacturer has completed the conformity assessment, prepared the technical documentation, complied with applicable labelling requirements, and supplied the required documents.<\/li>\n<li><strong>Own-brand consequence:<\/strong> An importer or distributor that places packaging on the market under its own name or trademark, or modifies packaging in a way that may affect conformity, may be treated as the manufacturer under Article 21, subject to the Regulation\u2019s specific exceptions.<\/li>\n<li><strong>R\u00fcckverfolgbarkeit:<\/strong> Packaging should carry a type, batch, serial number, or another element enabling identification. Manufacturer and importer identity information must also be supplied in the form permitted by the Regulation.<\/li>\n<li><strong>Document retention:<\/strong> The written declaration of conformity and technical documentation must generally be kept for <strong>f\u00fcnf Jahre<\/strong> after single-use packaging has been placed on the market and <strong>ten years<\/strong> after reusable packaging has been placed on the market.<\/li>\n<li><strong>Producer-responsibility reporting:<\/strong> Where a producer places less than 10 tonnes of packaging on a Member State\u2019s market during a calendar year, the simplified information specified in Annex IX may apply. The relevant information is submitted by 1 June for the preceding full calendar year, subject to the national registration and reporting system.<\/li>\n<\/ul>\n<div class=\"bioleader-key-takeaway\">\n<p><strong>Implementation action:<\/strong> Appoint an internal PPWR Owner with authority to stop imports, launches, or artwork approvals when technical documentation, conformity evidence, traceability information, or claim support is incomplete.<\/p>\n<\/div>\n<\/section>\n<hr \/>\n<section>\n<h2>2) Design for Recycling and Recyclability Grades<\/h2>\n<p><strong>PPWR recyclability grades A, B, and C become market-access conditions from 1 January 2030 or 24 months after the relevant delegated acts enter into force, whichever is later.<\/strong><\/p>\n<p>PPWR introduces a staged recyclability system rather than one immediate fixed requirement.<\/p>\n<ul>\n<li><strong>2030 design-for-recycling gate:<\/strong> Von <strong>1 January 2030 or 24 months after the delegated acts adopted under Article 6(4) enter into force, whichever is later<\/strong>, packaging may not be placed on the market unless it meets recyclability grade A, B, or C.<\/li>\n<li><strong>2035 recycled-at-scale gate:<\/strong> Packaging must also be recyclable at scale from <strong>1 January 2035 or five years after the relevant implementing acts enter into force, whichever is later<\/strong>.<\/li>\n<li><strong>2038 higher-performance gate:<\/strong> Von <strong>1 January 2038<\/strong>, packaging generally may not be placed on the market unless it meets grade A or B.<\/li>\n<li><strong>Delegated acts:<\/strong> The Commission must adopt the detailed design-for-recycling criteria and performance-grade methodology by <strong>1 January 2028<\/strong>.<\/li>\n<\/ul>\n<p>Annex II establishes the performance-grade framework. Grade C represents packaging that is recyclable by weight at a level of at least 70%, while packaging below the grade C threshold is treated as technically non-recyclable under the grading framework. The detailed assessment criteria for each packaging category will depend on future delegated and implementing acts.<\/p>\n<p>For coated fibre products, buyers should evaluate the body, coating, lid, label, adhesive, and printing system rather than treating paper as automatically recyclable. Buyers should not present 1 January 2030 as an unconditional date without this qualification.<\/p>\n<\/div>\n<p>The Commission must adopt the broader PPWR methodology for calculating and verifying recycled content, including sustainability criteria for recycling technologies, by <strong>31 December 2026<\/strong>.<\/p>\n<h3>Important 2026 Distinction: Decision (EU) 2026\/1425<\/h3>\n<p><strong>Commission Implementing Decision (EU) 2026\/1425 applies to single-use plastic beverage bottles under the Single-Use Plastics Directive, not to every plastic-packaging category under PPWR.<\/strong><\/p>\n<p>Commission Implementing Decision (EU) 2026\/1425 was adopted on 30 June 2026 and published on 3 July 2026. It establishes calculation, verification, and reporting rules for recycled plastic content in <strong>single-use plastic beverage bottles under Directive (EU) 2019\/904<\/strong>.<\/p>\n<p>A corrigendum published on 20 July 2026 replaced the Decision\u2019s annexes.<\/p>\n<p>This Decision is relevant to beverage bottles, but it should not be treated as the complete Article 7 methodology for all plastic packaging under PPWR. The broader PPWR implementing act is a separate legal requirement.<\/p>\n<p>PLA should also be treated separately from recycled-content plastics. Bioleader\u00ae\u2019s <a href=\"https:\/\/www.bioleaderpack.com\/de\/kompostierbare-pla-klarsichtbecher\/\" target=\"_blank\"><strong>PLA clear cup solution page<\/strong><\/a> covers plant-based cold-drink cups whose compostability and temperature limitations require a different evidence file from recycled PET packaging.<\/p>\n<h3>Importer and Brand Actions<\/h3>\n<ul>\n<li>Identify which Article 7 target category applies to each plastic packaging format.<\/li>\n<li>Confirm whether an Article 7 exemption applies.<\/li>\n<li>Collect post-consumer recycled-material declarations and chain-of-custody records.<\/li>\n<li>Record the manufacturing plant and annual averaging basis.<\/li>\n<li>Confirm that recycled food-contact plastics meet separate food-contact requirements.<\/li>\n<li>Include supplier change-notification and audit rights in purchasing agreements.<\/li>\n<li>Do not use Decision (EU) 2026\/1425 as the sole methodology for non-bottle packaging.<\/li>\n<\/ul>\n<\/section>\n<hr \/>\n<section>\n<h2>4) Compostable Items\u2014Narrow, Specific, and Dated<\/h2>\n<p><strong>PPWR does not require all foodservice packaging to be compostable; mandatory compostability applies only to specified packaging formats under Article 9.<\/strong><\/p>\n<p>Unter <strong>12 February 2028<\/strong>, the following must be compatible with the applicable standard for composting under industrially controlled conditions in bio-waste treatment facilities:<\/p>\n<ul>\n<li>Permeable tea, coffee, or other beverage bags intended to be used and disposed of together with the product.<\/li>\n<li>Soft after-use system single-serve units containing tea, coffee, or another beverage and intended to be used and disposed of together with the product.<\/li>\n<li>Sticky labels attached to fruit and vegetables.<\/li>\n<\/ul>\n<p>Where required by a Member State, these items must also be compatible with applicable home-composting standards.<\/p>\n<p>The Commission\u2019s June 2026 guidance clarifies that Article 9 is material-neutral. It may apply to paper-based as well as plastic-based tea bags, coffee bags, or other qualifying single-serve units.<\/p>\n<p>Member States may also require selected additional packaging formats to be compostable where compatible bio-waste collection and treatment systems exist, subject to Article 9(2).<\/p>\n<p>Other biodegradable or compostable packaging should not automatically be assumed to fall outside recyclability requirements. Keep technical evidence covering the complete formulation, thickness, coating, ink, adhesive, and label construction. Product certification may be used where relevant, but its scope must match the finished SKU.<\/p>\n<\/div>\n<p>Compostable knives, forks, spoons, wrappers, and kits should also be assessed at finished-product level.
